Am achten Ausschusstag standen der Investigativjournalist Michael Nikbakhsh und der Unternehmer Christian Mattura im Fokus – zwei Akteure, die vertrauliche Gespräche mitschneiden, ohne ihre Gegenüber zu informieren. Parallel vertiefen die Abgeordneten ihre Fragen zu Logfiles, Löschvorgängen und der ungewöhnlichen Wanderung von Datenträgern aus Pilnaceks Umfeld.
Bereits am Vortag hatten eine Einsatzleiterin am Fundort der Leiche sowie ein IT-Techniker aus dem Justizministerium ausgesagt. Der Techniker berichtete von zahlreichen unterschiedlichen Zugriffen und Löschungen auf Pilnaceks USB-Sticks, externen Datenträgern, seinem Laptop und seiner Smartwatch; eine große Menge an Daten sei abgezogen worden. Laut der grünen Fraktionsvorsitzenden Nina Tomaselli wurden in den Logfiles mehrere Änderungen und Einsichten durch verschiedene Polizeibedienstete festgestellt. Die Grünen kündigten einen Antrag auf Rüge des Justizministeriums an und gehen dabei von fraktionsübergreifender Zustimmung aus.
Nikbakhsh, der in seinem Podcast „Die Dunkelkammer“ die „wundersamen Wege“ von Pilnaceks Daten nachzeichnet, musste im Ausschuss auch zu einem Treffen in seinem „Kellerbüro“ Stellung nehmen. Am 9. Dezember 2023, rund eineinhalb Monate nach Pilnaceks Tod, trafen sich dort Pilnaceks Vertraute Karin Wurm, deren Mitbewohnerin Anna P., der Lobbyist Peter Hochegger und Unternehmer Christian Mattura. Mattura hatte das dreistündige Treffen initiiert. Hocheggers Erscheinen sei von einem mittlerweile verstorbenen deutschen Unternehmer veranlasst worden, der als eine Art väterlicher Freund Pilnaceks galt; Nikbakhsh sprach von eigener Überraschung über dessen Teilnahme. Zu dessen Rolle könne er wenig sagen, betonte aber, dass dieser Zweifel an einem Suizid Pilnaceks gehabt habe – Zweifel, die Nikbakhsh selbst weiterhin äußert.
Besondere Aufmerksamkeit gilt den Aussagen von Anna P., einer langjährigen Mitarbeiterin von Nationalratspräsident Wolfgang Sobotka, die im Ausschuss frühere Schilderungen aus dem „Kellerbüro“ abschwächte. Dort soll sie laut Nikbakhsh bereits 18 Minuten nach Beginn des Gesprächs berichtet haben, Bundespolizeidirektor Michael Takacs habe ihr geraten, Pilnaceks Laptop verschwinden zu lassen. Alkohol sei zu diesem Zeitpunkt nicht im Spiel gewesen, der Abend sei keineswegs „abstrus“ verlaufen, wie P. später im Ausschuss dargestellt habe. Parallel zeichnet der zweite Zeuge des Tages, Unternehmer Mattura, ein weiteres Bild der Causa: Er schilderte, wie er am 28. Juli 2023 in Pilnaceks Lieblingsitaliener in der Wiener Innenstadt ein Gespräch mit Pilnacek und dem gemeinsamen Freund Wolfgang Rauball heimlich mit seinem Smartphone aufnahm, nachdem sich Pilnacek über Druck aus der ÖVP in Rage geredet habe.
Monate später sei aus Matturas Sicht eine rote Linie überschritten worden, als Ex-Kanzler Sebastian Kurz öffentlich erklärte, die Wirtschafts- und Korruptionsstaatsanwaltschaft (WKStA) habe Pilnacek „aufgesessen“ beziehungsweise Jagd auf ihn gemacht. Diese Darstellung habe in krassem Widerspruch zu Pilnaceks Ausführungen beim Italiener gestanden, so Mattura. Er und Rauball hätten sich daraufhin entschlossen, die Aufnahme Medien zugänglich zu machen; Kurz’ Aussagen bezeichnete er als „Schweinerei“. Damit rückt der Ausschuss nicht nur die technischen Spuren von Logfiles, gelöschten Daten und wandernden Geräten in den Mittelpunkt, sondern auch die politische Sprengkraft vertraulicher Gespräche, die erst im Nachhinein und unter geänderten Rahmenbedingungen öffentlich werden.
